Terms of Service

1. Service Description

Foyer is an AI-powered phone receptionist service operated by Naptown Labs. We provide automated call answering, appointment booking, message taking, and call transfer capabilities for small businesses. The service is accessed through foyer.naptownlabs.dev and provisioned phone numbers.

2. Account and Eligibility

You must be at least 18 years old and provide accurate business information to use Foyer. You are responsible for maintaining the security of your account credentials and for all activity under your account.

3. Acceptable Use

You agree not to use Foyer to:

• Make or facilitate spam, robocalls, or unsolicited telemarketing.
• Engage in fraud, impersonation, or deceptive practices.
• Violate any applicable laws, including telecommunications regulations (TCPA, STIR/SHAKEN).
• Handle calls related to illegal activities.
• Interfere with or attempt to exploit the service infrastructure.
• Resell the service without written authorization.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

4. AI Disclaimer

Foyer uses artificial intelligence to handle phone calls. While we strive for accuracy, AI responses may occasionally be incorrect, incomplete, or misinterpret caller intent. The AI is not a substitute for professional advice (legal, medical, financial, or otherwise). You are responsible for reviewing call transcripts and verifying any appointments or messages generated by the AI. Naptown Labs is not liable for errors, misunderstandings, or missed information resulting from AI-processed calls.

5. Billing and Payments

Subscriptions are billed monthly through Stripe. Each plan includes a set number of minutes; overage is billed at $0.15 per minute. You may cancel at any time — cancellation takes effect at the end of the current billing period. Refunds are not provided for partial months. We reserve the right to change pricing with 30 days' notice.

6. Phone Numbers

Phone numbers provisioned through Foyer are leased, not owned. If you cancel your subscription, your assigned number(s) will be released after a 30-day grace period. We cannot guarantee number portability to other carriers.

7. Uptime and Availability

We aim for high availability but do not guarantee uninterrupted service. Downtime may occur due to maintenance, infrastructure issues, or third-party provider outages (Twilio, Bland.ai). We are not liable for missed calls or service interruptions.

8. Limitation of Liability

To the maximum extent permitted by law, Naptown Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost business, or data loss, arising from your use of Foyer. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Naptown Labs from any claims, damages, or expenses arising from your use of the service, your violation of these terms, or your violation of any third-party rights.

10. Modifications

We may update these terms at any time. Material changes will be communicated via email or a notice on the site at least 14 days before they take effect. Continued use after changes constitutes acceptance.

11. Governing Law

These terms are governed by the laws of the State of Indiana, United States, without regard to conflict of law principles.
